Terms and Conditions for Kismet.NZ Ltd

  1. Acceptance of Terms

    By confirming your order with Kismet.NZ Ltd, you agree to these terms and conditions. Any variations must be agreed upon in writing.

  2. Quotations
    • 2.1. All quotations are valid for 30 days unless otherwise stated. Prices are subject to change if the scope of work is altered. GST and shipping costs are additional unless specified.
    • 2.2. Quoted prices for graphic design work include up to two (2) rounds of revisions following the initial concept. Additional revisions or significant changes outside the original scope will be charged at the standard hourly rate or as otherwise agreed in writing. Design fees cover the creation of artwork for the agreed purpose. All quoted prices are based on the information provided at the time of quotation and may be adjusted if project requirements change.

  3. Payment Terms
    • 3.1. Payment is due within 14 days of the invoice date unless prior arrangements have been made.
    • 3.2. A deposit of 50% may be required before project commencement.
    • 3.3. Smaller orders and new clients may be required to make full payment before production or prior to shipping—this will be specified at the time of ordering.
    • 3.4. Late payments may incur interest at 2% per month.

  4. Cancellations and Changes
    • 4.1. Cancellations or significant changes after work has commenced may incur charges for completed work or materials ordered.
    • 4.2. Any design or production changes must be confirmed in writing.

  5. Delivery
    • 5.1. Delivery dates are estimates and depend on third-party suppliers and couriers. Kismet.NZ Ltd is not liable for delays outside its control.
    • 5.2. Freight and handling fees may apply.

  6. Ownership and Copyright
    • 6.1. All intellectual property created by Kismet.NZ Ltd remains our property until full payment is received.
    • 6.2. Upon payment, ownership of final deliverables transfers to the client. Raw design files remain the property of Kismet.NZ Ltd unless otherwise agreed.

  7. Liability
    • 7.1. Kismet.NZ Ltd is not liable for errors in materials approved by the client, including proofs.
    • 7.2. Our liability for defective work is limited to the cost of correcting or replacing the item(s).

  8. Warranties
    • 8.1. We guarantee that our work meets the specifications outlined in the approved order.
    • 8.2. External factors (e.g., weather exposure for outdoor signage) are outside our control, and warranties for durability are limited.

  9. Confidentiality
    • 9.1. All information provided by the client will be treated as confidential.
    • 9.2. We reserve the right to showcase completed work in our portfolio unless otherwise agreed in writing.

  10. Social Media and Promotional Use
    • 10.1. By engaging Kismet.NZ Ltd, you grant permission for us to photograph, record, and showcase the works for marketing and promotional purposes, including but not limited to our website, social media platforms, and printed materials.
    • 10.2. If you wish to opt out of promotional use, please notify us in writing before project completion.

  11. Governing Law

    These terms and conditions are governed by the laws of New Zealand. Any disputes will be resolved under New Zealand jurisdiction.
